Recent case law has provided a basis for employees to pursue allegations of workplace discrimination based on sexual orientation or gender identity.

In recognition of these developments, the Office of Personnel Management, the Equal Employment Opportunity Commission, the Office of Special Counsel, and the Merit Systems Protection Board issued a guide to Addressing Sexual Orientation and Gender Identity Discrimination in Federal Civilian Employment.
